Charter Quote Terms — New Air Club

The following terms and conditions govern all charter quotes, bookings, and flights arranged through New Air Club. By signing a charter quote or remitting payment, the Client agrees to all terms listed herein in their entirety.

Quote Validity

Quotes are valid for 10 days from the original date quoted, and are subject to operator aircraft and crew availability at the time of booking. The Standard Terms and Conditions attached hereto or on file with New Air Club and each provision therein are made a part of and incorporated within this Charter Quote.

Pricing

NAC quotes are all-inclusive of standard flight costs. Flight phone usage, if incurred, will be invoiced separately at the conclusion of the flight. In the rare event that fuel prices spike significantly above the rate in effect at the time of booking, a fuel surcharge may also be invoiced separately. Both will always be communicated to the Client in advance. No additional charges will be applied without prior notice.

Please note: in rare instances, fuel surcharge invoices may take 4–6 weeks to be billed to the customer due to lack of timely invoices from fuel providers.

Flight Acceptance, Deposit & Payment

Quoted price reflects a 4% cash discount. All quotes are subject to credit and operator approval. The signed quote, along with payment of 15% of the quoted total price, is required to book a flight. Remittance of payment for the full amount quoted must be received 2 weeks prior to the first scheduled departure.

Changes

All proposed Client flight itinerary changes are subject to New Air Club review, approval, and pricing revisions to reflect aircraft availability, performance, operational limitations, crew duty time restrictions, and related factors. New Air Club will, upon request, present the Client with an updated price quote reflecting the itinerary changes. Neither the lack of time for New Air Club to provide an updated price quote, nor the Client’s inability to receive, sign, and return written approval of an updated price quote, shall relieve the Client of its obligation to remit payment for all additional services provided.

Damage & Excessive Wear

The Client is financially responsible for the repair of damage or cleaning required as a result of excessive wear caused to the aircraft while in execution of the flight.

Operations

Flights are provided in accordance with FAA Regulations. In the event the carrier in its sole judgment determines that an operation is unsafe or a facility is inadequate, New Air Club may make reasonable changes to operations without liability of any kind to the customer or passenger. Customer and passenger will comply with instructions from New Air Club personnel and its agents.

FAA Regulations require that crew duty time must not exceed 16 hours per 24-hour period, which includes repositioning and wait time. Flight time may not exceed 8 hours in any 24-hour period.

Alcohol & Smoking

No passenger will be allowed to board a New Air Club aircraft who appears to be intoxicated, and no passenger may drink any alcoholic beverage unless it has been served by a crewmember. There is no smoking on any New Air Club aircraft.

Pets

A request to travel with a pet on board must be made at the time of booking and will be approved on a case-by-case basis. If the Client has not obtained written approval and the pet is not allowed on board, the Client is still responsible for the full amount of the booked charter flight.

Weapons & Hazardous Materials

New Air Club must be notified at the time of booking if passengers intend to transport anything resembling hazardous materials (HAZMAT) onboard any aircraft. Such materials may not be allowed on the aircraft. If a flight is cancelled or refused as a result, the Client is still responsible for the full amount of the booked charter flight.

Trip Interruption (Force Majeure)

In the event of cancellation and/or flight delays due to mechanical or maintenance issues, weather conditions, acts of terrorism, acts of God, or any other cause beyond New Air Club’s control, the Client will be responsible for payment of the completed portion of the trip and any additional costs incurred. New Air Club will make every effort to locate a suitable alternative; however, cannot guarantee the availability or price of any alternate aircraft. In the event unexpected delays are caused by passenger delays, weather, or other unforeseen circumstances beyond New Air Club’s control, the Client is responsible for payment of any additional charges as incurred.

Taxes

Unless specifically stated, this quote does NOT include FET Taxes, segment fees, governmental surcharges, international taxes, or handling in relation to transportation of persons by air. If these charges and fees are incurred, they will be invoiced separately.

Cancellation Policy

  • Within 45 days of scheduled departure: Subject to 15% cancellation penalty or actual costs incurred, whichever is greater.
  • Within 14 days of scheduled departure: Subject to 100% cancellation penalty or actual costs incurred, whichever is greater.

Late Payment

Any late payment for fees, miscellaneous expenses, or any other sums under this Agreement shall accrue interest at the rate of the lesser of eighteen percent (18%) per annum or the maximum lawful rate until paid in full.

Safety & TSA Requirements

For the safety of our passengers and to comply with TSA-directed security requirements, the following procedures are required:

  • 1.New Air Club must have a complete passenger list for each flight a minimum of 72 hours prior to scheduled departure.
  • 2.Each adult passenger (18 years or older) must have a valid government-issued photo ID and present it to the operational crew upon request and prior to boarding.
  • 3.All passengers on international flights, or those not holding a valid U.S. Government-issued photo ID, are required to submit copies of a valid passport and any other necessary documents a minimum of 24 hours prior to scheduled departure.
  • 4.All changes to the original passenger manifest must be confirmed with a New Air Club representative prior to the scheduled departure time and are subject to TSA review.
  • 5.All passenger baggage must have visible ID tags and remain with the passenger until loaded onto the aircraft.
  • 6.All baggage is subject to search by aircraft crew representatives. Due to aircraft size and capabilities, baggage limitations exist. Please inform New Air Club of any special requirements.
